The Moratorium on Licensed Home Care Services Agencies Extended Until October 1, 2010

Dear Interested Party:
The New York State Department of Health is extending the moratorium on licensed home care services agencies (LHCSAs) until October 1, 2010. This extension provides time for the Department to continue to work on revisions to the application and licensing process.
The following exemptions from the moratorium remain in effect:
- Licensed home care agencies associated with new Assisted Living Programs (ALP).
- Providers of HCSS under the Traumatic Brain Injury Program and Nursing Home Transition Diversion Waiver Programs.
- County/City Health Departments that provide public health nursing services in the home, including subcontractors for such services. An example would be those agencies that contract with NYC for the Nurse Family Partnership Program.
- Expansions of existing licensed home care agencies into additional counties when these additional counties have already been approved by the Public Health Council. This includes allowing additional sites when the agency has approval to provide services in the county where the new site will be located.
- Requests from existing licensed home care agencies to offer additional services.
- Changes in ownership of existing agencies.
- Applications that have received approval by the Public Health Council but have not completed all of the requirements for the issuance of the license.
- Agencies whose sole purpose is to provide services under the managed long term care program and have received approval by the NYSDOH to operate a MLTC program including a PACE.
- Entities that have received accreditation from a national accrediting body acceptable to the Department.
